From the June 25th email sent by Joanne Sereda regarding IRS Sec. 409A - "The school attorneys have researched this issue and advised us that there will be no additional tax obligation as long as we have on file a written election stating the pay plan option elected by each employee and provided the election remains unchanged for the school year and remains in place until the employee submits a new election form. The procedures the District already had in place for years comply with these requirement, ie, new unit members complete an Election of Pay Plan form at the time of hire and unit members subsequently changing pay plans were required to submit a signed request for the change.
So unless you are changing pay plans for 2008-09, it is not necessary for you to submit any additional paperwork regarding your choice of pay plan. If you do wish to change pay plans this year or in any future school year, submit the attached form no later than August 15 of the year in which you want the change to take effect."
